Please read these Terms of Service carefully before using Kayadata, including the website, Chrome extension and data dashboard (the “Service”). By accessing or using the Service you agree to these Terms.

1. Description of the Service

Kayadata is a data-driven toolkit with a browser extension and analytics dashboard to help users access, organise and analyse public data from marketplaces (Shopee, TikTok Shop) and social platforms (TikTok, Instagram). Data is shown to support more informed, efficient decisions.

2. No official affiliation

Kayadata is not partnered with, endorsed by, licensed by or affiliated with Shopee, TikTok, Instagram or other third-party platforms. Logos and trademarks belong to their owners and are used only for explanation or illustration.

3. Disclaimer on access and data collection

Kayadata does not scrape or pull data from third-party servers. Collection happens locally on the user’s device via the browser extension and is fully controlled by the user.

The user understands and agrees that:

• Kayadata only provides technical tools to make it easier to analyse data that is already publicly accessible.
• Actions and legal consequences of collecting third-party data are solely the user’s responsibility.
• Users must review, understand and follow the terms of every platform they access with the Kayadata extension.
• Using the tool to breach third-party terms or applicable law is a conscious choice by the user and is not instructed, encouraged or assumed by Kayadata.

4. User rights and responsibilities

Users are fully responsible for:

• How they use the Service and any data accessed through it.
• Ensuring use of obtained data does not infringe intellectual property, third-party terms or applicable law.
• Protecting account credentials and activity on the Kayadata platform.
• We ask users to use the Service legally and ethically, including product research, market analysis, business collaboration and marketing optimisation.

5. Consent to share public data among users

By using the Kayadata Service you understand and agree that:

• Public data you collect via the Kayadata extension may be shared in the dashboard so other official Kayadata members can access it.
• Dashboard sharing is limited to information that is already public on third-party platforms, and does not include private, closed or sensitive information.
• This sharing system is meant to improve collaboration, collective insight and the strategic value of data gathered by the Kayadata community.
• You confirm that you do not object to public data you access contributing to the shared dataset in Kayadata.
• If you do not want that data shared publicly in the Kayadata community, please do not use features that collect and share data via the dashboard.

6. Acceptable use

You may not use the Kayadata Service to:

• Reverse-engineer, copy or distribute data in ways that breach third-party terms.
• Commit fraud, break the law, or mass-exploit data for illegal purposes.
• Abuse features to bypass security or limits on external platforms.

7. Availability and changes

Kayadata may update, change or discontinue part or all of the Service at any time without prior notice. We may also restrict access if these Terms are breached.

8. Disclaimer and limitation of liability

The Service is provided “as is” without warranties, express or implied. We do not guarantee that:

• Presented data is fully accurate, complete or always up to date.

• The Service will be free of interruptions, bugs or third-party legal issues.

In no event is Kayadata liable for:

• Direct or indirect loss arising from use of the Service.
• Legal or financial impact from using third-party platform data.

9. Governing law

These Terms are governed by the laws of the jurisdiction where Kayadata operates. Disputes will first go to mediation before litigation.

10. Additional terms (user responsibility)

To clarify and restate:

• Kayadata is not responsible for legal impact or actions taken by third-party platforms against user activity.
• Any collection, storage, distribution or use of third-party site data is on the user’s initiative, control and risk.
• By using the Service you release Kayadata from claims that may arise from third parties due to your use of the platform.
• Using the Service indicates that you understand the related risks and are fully responsible for your use.

If you do not agree with any part of these Terms, you may not use the Service.
